Witnesses can make or break a case. Early, thorough collection of witness information is critical.
Initial Request
Were there any witnesses to your accident? This includes: people who saw it happen, people who stopped to help, anyone you spoke to afterward. Even if you don't have contact info, any details help - descriptions, what they said, business names if employees.
What to Collect
For Each Witness
- Full name
- Phone number
- Email address
- Relationship to you (stranger, coworker, friend)
- What they saw or heard
- Where they were positioned
Follow-Up Questions
You mentioned someone stopped to help at the scene. Can you describe them? Do you remember anything they said? Did they give you a business card or write anything down? Did police get their information?
Reluctant Witnesses
I understand the bystander seemed hesitant to get involved. Sometimes people are more willing to provide a written statement than testify. Would you be comfortable reaching out to them, or would you prefer I do it?
Social Media Witnesses
Sometimes witnesses post about accidents they saw on social media. If you're comfortable, search local Facebook groups or Nextdoor for posts about your accident. Screenshot anything you find and send it to me.
Time Sensitivity
Witness memories fade quickly. Request this information within the first week of signing a client.
