What to expect at your deposition and how to prepare for questions about your case.

A deposition is sworn testimony where the other side's attorney asks you questions. Here's how to prepare.

What is a Deposition?

  • Formal question-and-answer session

  • Your attorney will be present
  • Usually at an attorney's office

Before Your Deposition

  1. Review your accident details
  2. Look through your medical records
  3. Review your pain logs in the app
  4. Meet with your attorney for preparation
  5. Get a good night's sleep

Listen Carefully

Make sure you understand each question before answering. Ask for clarification if needed.

Answer Only What's Asked

Don't volunteer extra information. If the question can be answered yes or no, do that.

It's Okay to Say "I Don't Know"

If you don't remember something, say so. Don't guess.

Take Your Time

Pause before answering. This gives you time to think and your attorney time to object if needed.

  • How has this affected your daily life?
  • Any prior injuries or accidents?

After Your Deposition

Your attorney will discuss how it went. The transcript becomes part of the case record.
